SW PA Systems respects the privacy of our customers. We will never sell or share customer data with any third party or marketing agency.
Corrections, Changes, Errors and Order Cancellations
We may make changes to the pricing, features, functionality or content of the Site at any time without notice to you. We do not represent or warrant that the product information, pricing, or other information available on or through the Site will be correct, accurate, timely or otherwise reliable. We do not represent or warrant that the Site will be error-free, free of viruses or other harmful components, or that defects will be corrected. We reserve the right in our sole discretion to edit or delete any documents, information, prices or other content appearing on the Site.
If you place an order for item(s) that were priced incorrectly, you will be notified by a representative via email or phone. We apologize for the inconvenience caused by human error. We reserve the right to cancel any order for any reason at any time, including orders that may have any any indication of being a possible fraudulent or unauthorized purchase. We reserve the right to cancel credit card purchases going to freight forwarding companies, or alternate addresses that do not match the billing address of the cardholder (or are not listed an authorized alternate address by the credit card issuing bank). Customers who wish to use freight forwarding services must contact us directly to purchase.
SW PA Systems does not provide warranties or warranty service for the products listed on the site. All product warranties are direct from manufacturer, under their terms and conditions outlined on their company website. Customers are responsible for reviewing product warranties on the manufacturer's web site prior to making a purchase. We can not guarantee that product warranty information on the SW PA Systems will be current. Warranty repair service is done by the manufacturer or an authorized repair center. Customers may have to cover shipping costs associated with repair service, depending on the manufacturer's warranty terms of service. Customers ARE REQUIRED contact the manufacturer or SW PA Systems for a repair authorization number prior to shipping a product for warranty service.
You represent and warrant that if you are purchasing product(s) from us that (1) any credit information you supply is true and complete, (2) charges incurred by you will be honored by your credit card company, and (3) you will pay the charges incurred by you at the posted prices, including any applicable taxes. If we do not collect sales tax for your state, you are responsible for reporting and paying any applicable sales and use tax. Purchase Orders are required to be paid in full within 30 days of receiving an order. Late payments are subject to a $50 administration fee plus 1.75% interest per day. Payments may show "Smith Woodman Enterprises, LLC" on your credit card statement. Customer agrees to pay all transaction fees associated with accidental disputes or chargebacks.
Fraudulent or Unlawful Activity
We reserve the right to investigate complaints, suspicious activity, or reported violations of this Agreement and to take any action we deem appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, IP addresses and traffic information. We reserve the right to cancel and refuse, or delay, sale for any order that meets criteria of being suspicious or fraudulent.
Limitation of Liability
SW PA SYSTEMS DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING ANY LIABILITY FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR FOR LOST OR CORRUPTED DATA OR SOFTWARE, OR THE PROVISION OF SERVICES AND SUPPORT. SW PA SYSTEMS WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR STATUTORY DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCTS OR SERVICES BUNDLED WITH THE PRODUCTS, WHETHER FOR BREACH OF CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY IN TORT OR OTHERWISE, SW PA SYSTEMS SHALL NOT BE LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AGGREGATE DOLLAR AMOUNT PAID BY CUSTOMER FOR THE PURCHASE OF PRODUCTS OR SERVICES UNDER THIS AGREEMENT GIVING RISE TO SUCH LIABILITY. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
The wireless frequency spectrum is always evolving and changing as new technologies emerge. The FCC is consistently causing uncertainty with the rapid rise of mobile phone technology and its increased demand for bandwidth. Customers are responsible for staying up-to-date with any FCC wireless microphone regulations to ensure the purchased system can operate with as little hassle as possible. SW PA Systems is not liable for loss of product use resulting from FCC regulatory changes, performance issues caused by a crowded frequency spectrum, or discontinuation of frequency bands, product, or replacement parts
